The company SCI MALOU, real estate civil society with a share capital of €1000, whose registered office is located at 16 RUE DU PUY DU LOUP 87270 CHAPTELAT, registered with the Trade and Companies Register of Limoges under number 843 763 665, represented by Mr. Ludovic GABROT acting and having the necessary powers as manager.

Hereinafter referred to as the «Seller» or the «Company».

On the one hand,

PREAMBLE

The Seller has properties available for short-term rental. A list and description of the properties offered by the Seller can be found on the aforementioned website.

 

Article 1 – Purpose

These General Terms and Conditions apply to all bookings whether made online via the website, by telephone or by email.

They govern all the steps necessary for the completion and monitoring of the Client's reservation.

SCI MALOU specifies that the booking service is exclusively for adult clients. Any booking that does not comply with this restriction will be the responsibility of the client.

This site provides information on the description and prices of accommodations offered by SCI MALOU.

 

Article 2 – Application of the general terms and conditions of sale – enforceability 

These General Terms and Conditions of Sale can be viewed on the Site at the time of booking.

Before confirming their reservation, the Customer declares having read the General Terms and Conditions of Sale. The Customer's acceptance of these General Terms and Conditions of Sale and the pricing conditions necessarily occurs at the time of booking.

SCI MALOU may modify the General Terms and Conditions of Sale at any time. The Customer is therefore advised to carefully review the General Terms and Conditions of Sale in effect on the website at the time of each new booking.

 

Article 3 – Accommodation Booking Process

SCI MALOU offers the Client two types of processes for making their reservation:

  • Book immediately on the website https://chalet-alouette.fr through a dedicated and secure booking module.
  • Booking can be done directly by phone or email, depending on the availability of the accommodation and the agreement of the owner.

After entering the desired dates, the number of people, choosing the accommodation and providing the exact contact details, the Customer can view the summary of their booking and the corresponding prices. 

The total cost of the stay includes:

  • The price of accommodation
  • The tourist tax
  • An optional cleaning fee, depending on the accommodation chosen

The Client must then proceed to payment for their reservation, via one of two processes:

  • Payment for the entire stay

OR

  • A deposit of 40% is required upon booking.

A pre-authorization is then placed on your bank card to:

  • Payment of the security deposit indicated at the time of booking
  • The remaining 60% will be debited one month before the start of the stay. If the booking is made less than one month before the date of the stay, the amount debited will correspond to the total cost of the stay.

 

Article 4 – Payment

Payment and bank details are processed through the secure Stripe payment system.

The Company never has access to customers' bank details, which are encrypted via the SSL (Secure Socket Layer) protocol implemented by the Stripe platform.

 

Article 5 – Price

Prices are expressed in euros including all taxes (TTC).

The tourist tax is included in the accommodation price at the time of online booking. It will be payable on site if booking by email or telephone.

All reservations, regardless of their origin, are payable in euros.

The applicable rates are those displayed for the dates, accommodation and rate conditions selected at the time of booking.

SCI MALOU reserves the right to modify its rates at any time. However, it undertakes to charge for rentals at the prices indicated at the time of booking.

 

Article 6 – Caution 

At the time of booking payment, a pre-authorization is placed on your credit card as a security deposit. This pre-authorization is not charged and serves to guarantee payment of the deposit in case of damage. 

The amount of the bank imprint corresponding to the security deposit is the same for all accommodations.
The security deposit amount is set at €1000.

The bank imprint corresponding to the amount of the deposit is released within seven (7) days after payment of the services ordered on site and deduction of compensation retained for any damage, deterioration in the accommodation and regularization of tourist tax.

 

Article 7 – Modification or cancellation of the reservation 

 7.1 Modification

We accept any date changes subject to availability up to 14 days before your stay.

 

7.2 Cancellation

In the event of cancellation, the Client must notify the Company by mail, the date of sending the letter being considered the date of cancellation.

Our cancellation policy is as follows: 

  • Cancellation more than 60 days before the stay: the company retains 0% of the total booking amount and refunds the deposit paid, or the full booking amount, by bank transfer.
  • Cancellation between 30 and 60 days before the stay: the company retains 50% of the total booking amount.
  • Less than 30 days before the stay: the company retains 100% of the total booking amount.

7.3 – No right of withdrawal
In accordance with Article L. 221-28, 12° of the Consumer Code, the fourteen-day right of withdrawal does not apply to accommodation services, other than residential accommodation, which must be provided on a specific date or during a specific period.

Article 8 – Conditions of stay 

8.1 – Arrival and Departure Times

Accommodation is made available to the Client from 5:00 PM on the day of arrival and must be vacated by 10:00 AM on the day of departure.

The departure instructions are as follows:
- strip the beds and leave the bed linen and towels in the entrance
- Remove only the duvet covers, fitted sheets, and pillowcases
- leave the mattress protectors on the mattresses
- wash all the dishes and run the dishwasher
- take out the rubbish.
- reposition the key in the keybox
- cut the towel dryers

8.2 – Internal Regulations

Smoking is prohibited inside the accommodation.

Pets are welcome.

Doors and windows must be locked when the Client leaves the accommodation. 

People are asked to respect the neighborhood and not to engage in disruptive behavior.

 

Article 9 – Complaints – Customer Service

The Client has 48 hours after arrival to notify the main contact person for the accommodation in writing of any complaints regarding the description, quality, or cleanliness of the property. After this period, the Company will not consider any complaints relating to these points.

The Client can, however, provide feedback on their experience after booking by contacting the company SCI MALOU in writing.

 

ARTICLE 10 – Proof, preservation and archiving of transactions

The computerized records, kept in the computer systems of SCI MALOU in France under reasonable security conditions, will be considered as proof of communications, orders and payments made between the parties.

Invoice archiving is carried out on a durable medium in such a way as to correspond to a faithful and durable copy.

 

Article 11 – Partial Invalidity 

If one or more clauses of these General Terms and Conditions of Sale are held to be invalid or declared as such by application of law, decree or regulation or as a result of a decision of a competent court, the other clauses shall remain in force.

 

Article 12 – Jurisdiction and applicable law

These General Terms and Conditions of Sale are governed by French law.

In the absence of an amicable agreement, the dispute will be brought before the consumer mediator or before the competent French courts.

 

Article 13 – Contractual Information – Customer Acceptance 

The act of a natural or legal person making a reservation on the website https://chalet-alouette.fr implies full and complete acceptance of these General Terms and Conditions of Sale and obligation to pay for the services ordered, which is expressly acknowledged by the Client, who waives, in particular, the right to rely on any contradictory document, which would be unenforceable against the Seller.

Failure to comply with this prohibition constitutes copyright infringement and may result in civil and criminal penalties. It is strictly forbidden to use or reproduce the name ”CHALET ALOUETTE” or its logo for any purpose whatsoever, and in particular for advertising purposes, without the prior written consent of SCI MALOU.
